By using ../, requesting a quote, or engaging IWD Miami Services & Construction ("we", "us") for services, you agree to these Terms of Service. These terms supplement — but do not replace — the separate written contract executed at the start of any construction project, which governs the actual scope, pricing, schedule, and warranty of that project.

Website Use

This website is informational and provides a means to request quotes. Information is provided "as is" without warranty of accuracy or completeness. Pricing, rebate amounts, and program eligibility on the site reflect general estimates as of the published date and may change. Your actual quote and rebate eligibility are determined during on-site consultation and confirmed in your signed project contract.

Quote Requests

Submitting a quote request through this website does not create a contract or obligation on either party. We reply with availability, pricing range, and on-site visit scheduling. Either party may decline to proceed at any point before a written contract is signed.

Construction Contracts & Florida Law

All construction work is governed by a separate written contract conforming to the Florida Home Improvement Contractor (HIC) law (Mass. Gen. Laws c. 142A) and, where applicable, the Certified General Contractor (CGC) law. The signed contract specifies scope, materials, schedule, payment terms, change-order process, warranty, and dispute resolution. These website terms do not override the signed project contract.

Warranties

IWD Miami Services & Construction provides warranties as specified in each project contract. Standard warranty layers include:

  • Manufacturer warranty on equipment and materials, registered on the homeowner's behalf.
  • IWD Miami workmanship guarantee on installation labor for the period stated in the project contract (typically 5 years for HVAC and electrical work).
  • Florida Energy rebate guarantee for projects we file: if the rebate amount we quoted is not approved due to error on our side, we credit the difference.

Warranty claims are submitted in writing to hello@iwdmiami.com. Warranty service does not extend the original warranty period.

Florida Energy Rebates & Filings

For Florida Energy heat pump, insulation, and air-sealing projects, we file the rebate application on the homeowner's behalf at no extra cost as our standard practice. We do not control Florida Energy's eligibility decisions, processing time, or rebate amounts. We make our best effort to file accurately and on time and provide written confirmation of submission to the homeowner.

Pricing & Payment

Project pricing is fixed in the signed contract. Change orders are documented in writing and signed by both parties before work begins. Payment terms (deposit, milestone payments, final payment upon completion) are specified in the contract and conform to Florida HIC requirements (no more than 1/3 deposit unless special-order materials require more, with disclosure).

Limitation of Liability

To the fullest extent permitted by Florida law, our liability for any claim arising from this website (separate from a signed construction contract) is limited to direct damages and shall not exceed $100. This limitation does not apply to claims for bodily injury, fraud, or matters that cannot be limited under Florida consumer protection law (Mass. Gen. Laws c. 93A). Construction contract liability is governed by the signed contract and applicable law, not this clause.

Dispute Resolution

Florida homeowners have the right to initiate a complaint with the Florida DBPR. Construction contract disputes are first resolved through good-faith negotiation; if unresolved, through binding arbitration in Miami, Florida under the rules of the American Arbitration Association, except where Florida law provides for the homeowner's right to court (e.g., HIC arbitration program, Chapter 93A).

Intellectual Property

All website content (text, images, logos, design system) is owned by IWD Miami Services & Construction or licensed (Unsplash photos under the Unsplash License). You may not reproduce, redistribute, or create derivative works from the website content for commercial purposes without written permission.

Governing Law

These terms are governed by the laws of the State of Florida without regard to conflict-of-law principles. Any litigation that proceeds in court (after exhausting required dispute-resolution steps) shall be in Florida state or federal courts.

Changes

We may update these terms. Material changes will be posted with an updated "Effective" date. Continued use of the website constitutes acceptance.
